Settlement Offers as Evidence in Louisville Divorce

Earlier today, I was justly criticized by a Judge for placing a Divorce Settlement Offer I made on behalf of a client into the Court Record. I had intended it only as evidence of a client’s request for communication and documents. However, I did not redact the portion of the email that was an offer.

The reason Offers are not admissible is to encourage people to conduct frank and open settlement negotiations. If an Offer is made just to posture, then it is not a long term help to the case or client.
